ABOUT THE ORGANIZATION: Public Rights Project (PRP) is a public interest legal nonprofit, headquartered in Oakland, with a remote team based throughout the United States. Our mission is to close the gap between the promise of our laws and the lived reality of our most vulnerable communities. Since 2017, we have been working at the intersection of community organizing and state and local government enforcement to build a scalable, equitable community-based enforcement model to protect civil rights and advance economic justice. In the run-up to the 2024 presidential election, PRP has launched its Elections Protection Hub (EPH) to stand with progressive state and local governments, especially local elections officials, as they fight to protect the voting rights of their residents and secure safe and fair elections. The EPH is a rapid response litigation hub that will support up to 200 election officials across 12 or more states. The goal of the EPH is to provide training, technical assistance, and legal backup to election administrators to enable them to respond to election threats quickly and effectively. In addition, PRP’s EPH participates in broader election protection and pro-democracy coalition work, both to support litigation by partner organizations and to more effectively coordinate resources to defend against efforts to undermine free elections, threaten marginalized communities, and threaten the rule of law. PRP further supports local government partners in the face of an onslaught of abusive state preemption of local authority, defined as preemption efforts that disempower and harm marginalized communities. We support state and local governments, including Attorneys General, District Attorneys, City Attorneys, and State and Local Election Officials (Clerks, Election Boards, Secretary of States) with representation, legal strategy, research, fellowships, and community partnerships to help them develop strategies that protect their residents’ voting and civil rights. JOB SUMMARY Public Rights Project seeks to hire a Temporary Staff Attorney to join the EPH. The Temporary Staff Attorney will staff PRP’s in-house efforts to represent and advise state, local, and tribal governments and elected officials in support of election administration and the expansion of voting rights. Although this position does not incorporate formal supervisory responsibilities, the Temporary Staff Attorney will sometimes lead case teams and may review the work of other attorneys, alongside more independent work or work as a contributor to other case teams. This position reports to the Senior Staff Attorney and 2024 Election Hub Program Manager. This position will also work closely with the Chief Programs Officer and the Legal Director. ESSENTIAL DUTIES AND RESPONSIBILITIES Identify opportunities for advocacy and strategize pathways to action; Build and litigate complex matters in state and federal court; Advise, counsel, and represent PRP government clients on particular matters; Advise on case selection and strategy; Conduct legal research and provide guidance and analysis of laws on elections, voting, state constitutions, and preemption, across a range of jurisdictions; Draft, review, edit, and provide feedback on analytic and persuasive written work product; Communicate about PRP’s work to the public, including through public speaking, conversations with the press, and drafting press statements, “explainers,” and op-eds, and Work well independently and collaboratively. EDUCATION AND/OR EXPERIENCE Licensed to practice law in a jurisdiction of the United States At least 4 years relevant experience as an attorney. Relevant experience may include government enforcement, complex civil litigation, and/or advice to government officials Litigation experience is strongly preferred Constitutional law experience, election administration experience and/or administrative law experience is strongly encouraged, but not required Prior experience with remote work in large teams in support of a fast-moving campaign-like program. KNOWLEDGE, SKILLS, AND ABILITIES Outstanding writing and editing skills, including drafting and editing complex briefs and legal analysis. Experience working on issues of constitutional law or election protection preferred. Experience working with state and local officials is a plus. Ability to support significant public interest litigation. Team player who can work with government partners, co-counsel, community-based organizations, and other advocates, as well as internal teams. Outstanding judgment about both legal issues and strategy Display a positive and respectful attitude, work well with diverse people and communities, demonstrate presence, self-confidence, common sense, and good listening ability. A belief in the power of state and local government to make positive change in the world. A passionate commitment to economic, racial, and gender justice. OTHER DUTIES AND RESPONSIBILITIES Contribute to grant proposals, reports, and periodic communication pieces in addition to previously identified Elections Hub support work. Other duties as designed. ORGANIZATIONAL RELATIONSHIP This position reports to the Senior Staff Attorney and 2024 Election Hub Program Manager. This position will also work closely with the Chief Programs Officer and the Legal Director. PHYSICAL DEMANDS Requires sitting, talking, and listening for up to 8 hours per day. Certain situations may require lifting items up to 20 pounds. WORK ENVIRONMENT Fully remote organization and team. This role may require travel a few times a year to PRP events, case hearings, or meetings. We currently have remote staff in Anchorage, Boston, Chicago, Kansas City (MO), Los Angeles, New York, Oakland, Seattle, and Washington, DC, as well as other cities. COMPENSATION The determined salary range for this role is set at $87,413 -$108,675 (for internal equity, PRP will not engage in salary negotiations; salaries are presently set based on years of experience).
